I researched the Dept of Finance property records to see how it was financed the last time there was a mortgage used.

If that doesn&#039;t work, I&#039;ll usually head down to Dept of HPD&#039;s Code Enforcement Unit to see if an I-Card is on file.  I-Cards were the way HPD recorded floor plans and occupancy for each registered building back in the 1930&#039;s.

As for how NYC Dept of Finance determine&#039;s how to tax you, they usually look at the square footage of a lot first and then how much square footage is contained inside a building.  

Depending on how much living space exists inside a building will determine the tax class it&#039;s assigned to determine its tax rate.

What I did at 564 Jefferson Ave to solve is to determine if the property had ever previously been financed with a conventional home loan by a mortgage lender. If the lender had underwritten that mortgage using Fannie Mae conforming loan standards, then their opinion of the property’s use would be in the mortgage note recorded.

 

While it requires some research (and knowing what you’re looking at so you can prove it to a Title Agent and Lawyer) the fact that a title insurer underwrote a title policy against the financing proves more than one party agreed.
